These Terms of Use ("Terms") apply to Vaelareth: Text RPG Roguelike ("Vaelareth", "the game"), made by Jereneo Joven, an independent developer based in the United Arab Emirates ("we", "us", "our"). By installing or playing the game, you agree to these Terms and to the Google Play Terms of Service. If you don't agree, please don't use the game.
Nothing in these Terms takes away rights you have under the consumer protection laws of the country where you live that can't be waived by contract.
You must be at least 13 years old to play. If you're under 18, or under the age of majority where you live, a parent or guardian must agree to these Terms for you and should approve any purchases.
We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on devices you own or control, for your own non-commercial entertainment. You may not:
The game is single-player and offline. We don't police how you play your own saves, but we don't support modified copies or edited save files. If they break your progress, we can't restore it.
Streaming and videos. You're welcome to stream, record and post videos or screenshots of the game, and to make money from them on platforms such as YouTube or Twitch, as long as you don't present them as official content.
We, or our licensors, own the game and everything in it, including the story, code, art, music, names and logos. The game uses third-party art and music under licence, and the in-game credits list them. These Terms give you no ownership rights. All rights not expressly granted are reserved.
Feedback. If you send us ideas or suggestions, you allow us to use them freely, without payment or credit.
4.1 Google Play. All purchases are made through Google Play and are also covered by Google Play's terms and refund policies. Prices are shown in the store before you buy, and Google adds any applicable taxes.
4.2 Premium is a one-time purchase that permanently unlocks the perks listed in the game on your Google account. You can restore it on a new device or after reinstalling by signing in with the same Google account.
4.3 Gems. Gems are an in-game currency. You earn them by playing, and you can buy gem packs. Gems:
4.4 What you get. Items bought with gems (unlocks, cosmetics, the Second Trait Slot) are delivered immediately and can't be returned. We may rebalance the game over time, for example by changing drop rates, prices in gems or perks. We won't remove something you bought with real money without giving you a reasonable replacement or a refund, unless the law requires the removal.
4.5 Refunds. Refunds are handled by Google Play under its refund policy. If something you paid for didn't arrive, email us with your Google Play order number and we'll help.
4.6 EU/UK right of withdrawal. If you live in the EU or UK, you normally have 14 days to withdraw from an online purchase. Purchases in the game are digital content delivered immediately. By completing a purchase, you ask for immediate delivery and acknowledge that you lose your right of withdrawal once the content is delivered.
4.7 Future expansions. Any expansion will be sold under these Terms, plus any extra terms shown when you buy it.
Your progress is saved on your device (see the Privacy Policy). We're not responsible for progress lost through uninstalling the game, clearing its data, using Erase all progress, a device failure, or a lost device. Updates may change game content. We try to keep saves compatible, but we can't guarantee that a save carries over every change.
We may update, change or stop offering the game, or any part of it, at any time. If we stop offering the game, copies already installed will keep working offline as long as your device supports them. We have no obligation to provide support, although we'll try to help when you email us.
Our Privacy Policy explains how we handle information, and it forms part of these Terms.
The game is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the game will be error-free or uninterrupted. Some countries don't allow these disclaimers, so they may not apply to you.
The game is a work of fantasy fiction. Its themes include violence, death and "madness". These are story mechanics, not depictions of, or advice about, real mental health.
To the extent the law allows:
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited under the law that applies to you. For EU/UK consumers, we're also responsible for foreseeable loss caused by our breach of these Terms or our failure to use reasonable care and skill.
You can stop using the game at any time by uninstalling it. If you seriously break these Terms, for example by distributing pirated copies, your licence ends automatically. Sections 3, 4.3, 5, 8, 9 and 11 continue to apply after your licence ends.
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Abu Dhabi. Please contact us first, because most problems can be sorted out by email. If a dispute can't be resolved within 30 days, it may be brought before the courts of Abu Dhabi. However, if you're a consumer, you can also bring a claim in the courts of the country where you live, and you keep the protection of that country's mandatory consumer laws.
